医疗损害责任纠纷中司法鉴定人出庭现状的实证分析——基于中国裁判文书网10年案例

摘　　要：日益增多的医疗损害责任纠纷已然成为我国构建和谐医患关系的障碍,由于医学知识的专业性和复杂性,鉴定意见成为审理此类案件的重要依据。司法鉴定人出庭对于法官通过质证,解决鉴定意见争议,避免技术权对司法权的僭越,实现司法公正具有重要意义。有鉴于此,以"医疗损害责任纠纷"案由,运用关键词"司法鉴定""鉴定人出庭"检索中国裁判文书网,研读2010年7月1日--2020年6月30日我国医疗损害责任纠纷司法判决文书,对纳入的60047例案例进行描述性统计分析,从案例分布的时间、地区、司法鉴定数量、申请鉴定人数量、司法鉴定人出庭情况及鉴定意见采信情况等数据分析司法鉴定人出庭现状并提出完善对策,规避和减少医疗损害责任纠纷案件,以期为我国医患关系健康可持续发展提供参考。The increasing disputes over liability for medical damages have become an obstacle to building a harmonious doctor-patient relationship in China.Due to the professionalism and complexity of medical knowledge,expert opinions have become an important basis for hearing such cases.The appearance of judicial appraisers in court is of great significance for judges to pass cross-examination,resolve disputes of expert opinions,avoid the violation of judicial power by technical power,and realize judicial justice.In view of this,based on the case of"medical damage liability dispute",it is suggested to use the keywords of"judicial expertise"and"expert witness appearing in court"to search"China Judgment Document Network",study the judicial judgment documents of medical damage liability dispute in China from July 1,2010 to June 30,2020,and make descriptive statistical analysis on 60047 cases included.This paper analyzes the present situation of judicial appraisers appearing in court from the data of case distribution time,area,number of forensic experts,number of appraisers applying,appearance of judicial appraisers in court and acceptance of appraisal opinions,and puts forward some countermeasures to avoid and reduce medical damage liability disputes,so as to provide reference for the healthy and sustainable development of doctor-patient relationship in China.
