摘　　要：推进产业政策立法需要探寻立法依据和法源,产业政策有较成熟的理论和政策体系,基于产业政策视角研究产业政策立法符合理论逻辑和现实逻辑。推进产业政策立法,政府应树立产业政策的法治思维,实现功能性产业政策法与选择性产业政策法的有效结合,构建产业政策法律框架,提升产业政策法律化程度和层次。To promote the legislation of industrial policy,we ne ed to explore the legislative basis and source of law.Industrial policy has a relatively mature theory and policy system.It is in line with the theoretical and practical logic to study the legislation of industrial policy from the perspective of industrial policy.To promote the legislation of industrial policy,the government should establish the legal thinking of industrial policy,realize the effective combination of functional industrial policy law and selective industrial policy law,construct the legal framework of industrial policy,and enhance the legalization degree and level of industrial policy.
