摘　　要：近年来,我国贪腐人员纷纷选择潜逃境外以躲避法律的追责,在这一过程中也使得大量资产流入境外,影响了我国经济的发展和政治的稳定,也影响了我国良好国际形象的建立,因此,如何让逃亡海外的贪腐人员早日受到法律的制裁也成为近年来国家反腐的重要课题之一。值得注意的是,作为最常规的追逃措施,我国引渡机制仍存在不完善之处,例如在传统引渡原则适用方面、人权保障国际衔接方面、引渡适用程序方面存在诸多障碍,以致我国采用引渡措施成功追逃贪腐人员的案例十分罕见,特别是从西方发达国家引渡成功的案例更是寥寥无几。基于此,笔者从灵活处理引渡原则问题、完善引渡中的人权保障机制、加强引渡程序建设、综合运用其他措施四个方面提出了完善我国外逃贪腐人员引渡机制的建议,以期为推进我国反腐败境外追逃工作有所裨益。The grafters in our country have chosen to abscond from abroad to avoid legal accountability in recent years and a large amount of assets flowed into overseas in this process,which affected our country’s economic development and political stability,and also affected China’s image.Therefore,how to make the corrupt persons who fled overseas be sanctioned by law as soon as possible has become one of the important issues in the country’s anti-corruption efforts in recent years.It is worth noting that,as the most conventional measure to pursue fugitives,our country’s extradition mechanism still has some imperfections.For example,there are many obstacles in the application of the traditional principle of extradition,the international connection of human rights protection,and the application procedure of extradition.As a result,it is very rare for China to adopt extradition measures to successfully hunt down grafters,especially the successful extradition cases from Western developed countries are even more rare.Based on this,the author puts forward suggestions to improve the extradition mechanism of corrupt fugitives in China from four aspects:flexible handling of the principle of extradition,improving the mechanism of human rights protection in extradition,strengthening the construction of extradition procedures,and comprehensively applying other measures.It is expected to be of benefit to the anti-corruption work of pursuing fugitives abroad.
