摘 要:在发生海上事故造成船舶及随船货物沉没的情况下,通常船方和货方会相互推诿打捞清除责任,甚至出现无人打捞的现象。然而当随船沉没的货物仍有较为可观的剩余价值时,货方却往往十分愿意承担沉货打捞清除责任以期获得更大的经济利益,在这种情形下,易出现船货双方争夺打捞权的问题。根据相关法律法规,结合具体案例,围绕沉船沉货打捞中货方打捞权的问题进行分析和探讨,就“准商业打捞”下船、货双方的打捞权问题提出见解,即船方应被认定为负有打捞沉船沉货的责任主体或行政相对人。In the case that the vessel and the cargo sinks as a result of a marine accident,the shipowner and the cargo owner usually shuffle the responsibility of salvage and clearance to the other party,sometimes even leading to no salvage.However,when the cargo involved still has considerable value,the cargo owner is quite willing to undertake the responsibility of salvage and clearance in order to obtain greater economic benefits.In this case,the two sides may fight for the salvage rights.According to relevant laws and regulations and in view of specific cases,the paper studies the cargo owner's right for the salvage of the sunken vessel and cargo,and puts forward opinions on the rights of both the shipowner and cargo owner for the salvage under the case of“quasi-commercial salvage”.It believes that under such circumstances,the shipowner is the liable party or the administrative counterparts for the wreck removal of the sunken ship and cargo.
