论我国传染病防控公共卫生事权配置的优化

摘　　要：传染病防控公共卫生事权按项目在中央和地方政府之间划分之后,还需按事权的要素即决策权、执行权及监督权在立法中设计相关制度来进行三权的具体配置。这些制度在经过2020年新冠肺炎疫情后充分暴露出一系列问题,比如预警主体设置级别过高、疫情信息发布主体设置不合理等等。为此,需要及时进行立法后评估,优化传染病防控公共卫生事权配置,调整预警制度,完善紧急状态下的信息公开制度,规范行政强制措施的运用,实现中央指导组、各级纪委监察委以及卫生行政部门监督的有机结合,以提升地方政府应对传染病公共卫生事件的主动性和积极性。The public health administrative power for prevention and control of infectious diseases should be divided between the central and local governments according to the project.And it is also necessary to design relevant systems in the legislation according to the elements of the authority,namely,the decision-making power,the executive power and the supervision power for the concrete allocation of these three powers.However,these systems have been fully exposed to a series of problems after the outbreak of public health events,particularly the outbreak of COVID-19 in 2020.For example,the level of warning subject setting is too high and the setting of epidemic information releasing subject is unreasonable.Therefore,it is necessary to carry out post legislation evaluation in time,optimize the allocation of public health administrative power for the prevention and control of infectious diseases,adjust the early warning system,improve the information disclosure system in case of emergency,standardize the application of administrative coercive measures,and realize the organic combination of supervisions of the central steering group,the discipline inspection commission at all levels and the supervision of the health administration department so as to enhance the proactivity and positivity of local governments in dealing with infectious diseases.
