摘　　要：重新审视证据契约的基本理论,对证据契约制度的构建提出初步设想,并通过立法,明确不同类型证据契约的效力和适用规则,为证据契约的适用提供依据。This paper re-examines the basic theory of evidence contract,puts forward preliminary ideas for the construction of evidence contract system,and clarifies the effectiveness and application rules of different types of evidence contract through legislation,so as to provide the basis for the application of evidence contracts.
