高校横向科研合同风险管控要点实践及思考——以某医学院为例

摘　　要：在不断深化高校产学研合作的政策引导下,高校与社会各领域和部门的合作越来越广泛,横向合同数量日益增多。横向科研的合作形式以科研合同为主。以某医学院为例,从横向科研合同的全流程管理入手,分析并探讨高校横向科研合同中风险控制的实践。研究发现横向科研合同管理中存在合同订立、履行、知识产权、校名校誉使用、伦理审查、人类遗传资源使用等各种风险。通过完善审核制度、建设信息化管理、加强知识产权管理、规范学校名称使用、建立伦理审查模块及人类遗传资源管理模块等方式,可有效降低相关风险的发生。Under the policy guidance of deepening the university industry research cooperation,the cooperation between universities and various fields and departments of society is more and more extensive,and the number of crosswise research of colleges and universities is increasing day by day.Taking a medical college as an example,this paper analyzed and discussed the practice of risk control in the crosswise research contracts from the whole process management.The research found that there were several aspects in the management of crosswise research contract,such as contract signing,implementation,intellectual property rights,the use of school name and reputation,ethical review,and the use of human genetic resources.Through improving the audit system,building information management,strengthening intellectual property management,standardizing the use of school names,establishing ethical review module and human genetic resources management module,the occurrence of related risks can be effectively reduced.
