摘　　要：[目的/意义]对当前图书馆数字资源引进过程中著作权合同实质不公平问题进行研究,分析其特征、原因并进行对策分析.[方法/过程]采取文献法、案例法以及比较法学的研究方法对面向图书馆数字资源引进的著作权问题进行阐述.[结果/结论]图书馆数字资源引进过程中著作权合同具有实质不公平的特征;当前我国著作权专门合同规则的缺失是导致该问题产生的主要原因;实现图书馆数字资源引进著作权合同实质公平的规则调整建议主要有4个方面,包括:明确面向图书馆数字资源长期保存的许可使用规则;增加面向图书馆的技术措施保护限制与例外;对著作权限制与私立著作权规则关系进行调整;合理引入反垄断规则.[Purpose/significance]This paper studies the unfair nature of copyright contract in the process ofintroducing digital resources into the library,and analyzes its characteristics,causes and countermeasures.[Meth-od/process]using the research methods of literature,case and comparative jurisprudence,this paper expounded thecopyright problem of digital resources introduction to library.[Result/conclusion]'This paper analyzes the charac-teristics of the substantial unfairness of copyright contract in the process of library digital resources introduction fromthree aspects;expounds that the main reason for this problem is the lack of special contract rules of copyright;andputs forward specific suggestions from four aspects,including:clarifying the license rules for the long-term preserva-tion of digital resources in the library;increasing the protection restrictions and exceptions of the library orientedtechnical measures;adjusting the relationship between copyright restriction and private copyright rules;and reasona-bly introducing anti-monopoly rules.
