农地制度变迁视角下的三权分置:1949—2020

摘　　要：将“三权分置”置于一个较长时期进行分析,通过对新中国成立以来农地制度变迁的梳理,即“单一产权”时期(1949—1978)、“两权分离”时期(1978—2014),再到“三权分置”(2014—2020),尤其是“三权分置”实施以来,理论界对“三权分置”中三权的界定、“三权分置”的政策目标、“三权分置”的金融支持、“三权分置”的传统渊源、“三权分置”的后续问题等方面,进行一一综述,并总结出如下结论,即在农地制度变迁中,如果能充分尊重并吸取正式制度(政府规定)和非正式制度(民间自发)的优势,就能使个人或家庭经济效益最大化与国家或集体的经济效益最大化结合起来,使个人收益率不断接近社会收益率,从而实现总体的经济增长和社会发展;否则,就会给社会经济建设带来波折甚至是挫折。This paper analyzes the“three rights division”in a long period and combs the institutional changes of farmland since the founding of new China,namely,the period of“single property right”(1949-1978),the period of“separation of two rights”(1978-2014),and then the period of“separation of three Rights”(2014-2020).Especially since the implementation of the three rights division,the theoretical circle has made a summary of the definition of the three rights division,the policy objective of the three rights division,the financial support of the three rights division,the traditional origin of the three rights division,the follow-up problems of the three rights division and so on.And it summed up the following conclusion:In the change of farmland system,if we can fully respect and absorb the advantages and advantages of formal system(government regulation)and informal system(civil initiative),we can combine individual or family economic benefit maximization with national or collective economic benefit maximization,then the personal rate of return is constantly close to the social rate of return,so as to achieve overall economic growth and social development;Otherwise,it will bring twists and turns or even setbacks to social and economic construction.
