显著性视角下商标使用体系化作用研究

摘　　要：商标使用是商标显著性产生与维持的基础,通过将商标置于市场之中使其发挥激发商标标志与所附着商品或服务信息之间联系为相关消费者所认知的作用,并经消费者的反复认知使这种联系处于一定、特定且稳定的状态。随着市场经济的发展,商标通过使用其功能也逐渐扩张,形成了以来源识别功能为基础的广告宣传等多元商标功能体系,使商标内含的信息不断丰富。商标显著性便是诸多功能激发标志与信息联系作用效果有无强弱的反映,是贯穿于整个商标体系的重要纽带。因此,以显著性为表征的商标使用于商标权取得与维持的存续阶段和反混淆与反淡化的保护阶段即在商标权运行的各个方面均发挥了重要作用,应当予以足够重视,从而完善我国注册商标使用义务规则体系。Trademark use is the basis of the produce and maintenance of distinctiveness of trademark,by placing trademark in the market to make the function of trademark to stimulate the connection between the mark and the attached goods or service information for the relevant consumers’understanding,and by repeated repetition of the consumer makes the connection in a certain,specific and stable state.With the development of market economy,the trademark function has gradually expanded on trademark use,forming a multi-mark function system contained multi-brand function and so on which is based on the source recognition function,so that the information contained in the trademark is constantly enriched.And the trademark distinctiveness reflects the reaction to the mark and information contacts which stimulated by a lot of function,distinctiveness the important link throughout the trademark system.Therefore,the trademark use reacted by distinctiveness which plays an important role in the acquisition and maintenance of trademark rights survival stage and the anti-confusion and anti-dilution protection stage,that is,all aspects of trademark rights,should be given enough attention.So as to perfect the use obligation system of registered trademarks in China.
