摘　　要：行政强制作为一种典型的侵益性行政行为,天然地具有惩戒违法行为、保障公共秩序的行为意蕴。然而,某些地方立法过于重视行政强制规范功能的发挥,采取直接或间接地创设实施违法建设拆除权,导致地方立法在很大程度上与《行政强制法》等相关上位法相抵触。地方立法突破上位法的规范限定不仅严重悖离其系执行性立法的功能定位,而且对于我国法制统一的框架体系亦会造成不容小觑的戕害破坏。据此,有必要坚守一种审慎的法治思维,运用和重申法律位阶、依法立法等行政法基本原则理念,论证反思我国地方立法的规范定位与行使边界,进而促进地方立法在契合法制统一的制度前提下,提升其依法立法、规范执法等方面的治理能力。As a typical administrative act of infringing act,administrative compulsion naturally has the meaning of punishing illegal act and safeguarding public order.However,some local legislations pay too much attention to the exertion of the function of administrative compulsory norms,and take direct or indirect measures to create and implement the right of illegal construction and demolition,which results in local legislations to a large extent being in conflict with the administrative compulsory law and other relevant superior laws.Local legislation breaking through the norms of upper law not only seriously deviates from the functional orientation of executive legislation,but also causes damage to the unified framework system of legal system.Therefore,it is necessary to stick to a prudent thinking of the rule of law,use and reaffirm the basic principle and concept of administrative law,such as legal rank and legislation according to law,demonstrate and reflect on the normative positioning and exercise boundary of local legislation in China,and then promote the governance ability of local legislation in terms of legislation according to law and law enforcement under the premise of the system of legal unification.
