摘　　要：学者们从不同层面对人格权概念展开激烈而持久的论辩,但仍有诸多疑难问题未达成统一意见.重要原因在于伦理人格与人格权概念的内在关联被忽视.目前学界对人格权的界定有两大方法:主体界定法和客体界定法.人格概念作为一个基石性哲学范畴成为研究的切入点.人格具有主客体同一的结构,使呈现同样结构的人格权成为一种新型的权利,其权利结构为:主体—人格(作为应然权利)或法律人格(作为法定权利);客体—人格及其诸要素.“主客体同构”决定了作为主体的人格可作为权利载体而存在,使主体呈现客体性.反之,作为权利载体的客体—人格及其诸要素,作为权利内容除具有客体性,还呈现出主体性(精神性).Scholars have a enduring and fierce debate about the concept of personal rights from different levels.But many difficult problems did not reach consensus.An important reason is that the inherent ethical personality associated with the concept of moral rights are ignored.Currently the academic definition of the right of personality,there are two methods;definition by subject and definition by object.It is a effective method for investigating the philosophical origin of personal right that clarifying the similarities and differences of conceptions about ethical personality,juridical personality and personal right The concept of personality which acts as a basic philosophical category is a beginning-point for this study.Personality possesses a structure of subject and object identity,which makes personal right that contains the same structure as that of it become a new kind of right.This right consists of the subjective personality(acting as obligatory rights)or juridical personality(acting as legal rights),the object personality and aspects of it.The isomorphism between subject and object determines that the subjective personality could exist as a right carrier and make subject have the objectivity.In the contrary,the object personality and aspects of it as a right carrier possesses not only objectivity,but subjectivity(spirituality),when they act as the content of the right.
