摘 要:在新时代和新发展格局的背景下,畅通国内大循环必须破除影响商品、要素自由流通的体制机制障碍。经济法治如何服务和回应现实,就在于让经济法真正实现控制政府经济权力,保障市场决定性作用的发挥。如何实现经济法控权,存在着一种理想与现实之间的分野。从理想图景来说,立法对政府干预经济进行有效制约,政府经济行为制定和实施程序得到健全和约束,市场主体的经济权利得以彰显,权力主体的责任追究机制完备,均是有效实现经济法控权的可行路径。就现实而言,却存在广义经济立法扩张对市场竞争行为带来损害,政府经济行为决策和实施程序不规范,市场主体权利未能周全保障,权力主体责任阙如等问题。In the context of the new era and the new development pattern,to smooth the domestic cycle,we must remove the system and mechanism barriers that affect the free circulation of commodities and elements.How the economic rule of law serves and responds to reality lies in enabling economic law to truly control the government’s economic power and ensure the decisive role of the market.As for how to achieve economic law control,there is a division between ideal and reality,however.From the perspective of the ideal picture,effective paths in realizing economic law control may include legislative restriction of government intervention in the economy,sound and restricted government economic behavior formulation and implementation procedures,the demonstration of the economic rights of market entities,and a complete accountability mechanism of power entities.In reality,there are problems such as the damage caused by the expansion of broad economic legislation to market competition,non-standardized economic behavior decision-making and implementation procedures of the government,non-fully guaranteed rights of market entities,and absence of the responsibilities of power entities.
