摘 要:阿瑟·米勒在《萨勒姆的女巫》开场时所作的"谬论"的叙述引起了众多批评者的兴趣。这一"谬论"究竟是什么?悲剧又是如何在这一"谬论"中发展?从法律的角度看,贯穿全剧始末的辩论、答疑和推理或为剧本的解读提供了一个不同于"麦卡锡"主义的解读视角,即这一"谬论"实为剧中"法律事实"与"客观事实"之间的背离。同时,剧中悖谬的产生并非凭空而来,而是控辩双方对"事实"的建构与"争论"这一修辞论辩过程的结果。如此看来,在对剧中的"司法不公"与"宗教权力"进行批判之余,强调解释、论证与总结的法律修辞论辩或许也是读者值得深思的地方。Critics are rather interested in the"paradox"Arthur Miller discussed at the beginning of his play The Crucible.What does the"paradox"refer to and how does the tragedy develop from such a"paradox"Given that the whole play is filled with people′s induction,deduction as well as their debates especially in the court,jurisprudential researches may thus give a different answer by merely explaining them as the"McCarthyism",which this paper believes is the"paradox"between the legal fact and the objective fact.Meanwhile,this paradox does not come from nowhere;it is instead shaped as the result of the"rhetoric debate",namely the construction of"fact"and debate on whether such"fact"is rational.Therefore,in addition to criticizing the miscarriage of justice and"religion power"the play has demonstrated,critics should also invest attention to the rhetoric debate involved in The Crucible.
