摘 要:随着经济的不断发展,物质上的满足已不再是人们的首要期盼,而精神上的享受正逐渐成为人们的首要追求,在此情境下,给予人们精神美感享受的室内设计行业的出现成为必然。然而,我国现有的著作权保护存在一定的滞后性,导致室内设计作品处于随时被侵权的高风险境地。具体而言,由于立法规定的滞后,导致在确定室内设计作品的权利保护基础时,出现了一元论和二元论的分歧。此种分歧的存在,将不利于相关主体的利益维护,因此,必须尽早在立法中确定室内设计作品的权利保护基础。在综合分析室内设计作品从平面到立体过程本质的基础上,可以得知二元论在保护室内设计作品中明显优于一元论。With the continuous development of the economy, people in the pursuit of a qualitative change occurred. Material satisfaction is no longer the people’s first look forward to, and spiritual enjoyment is gradually becoming the first pursue, in this context, the beauty of the interior design industry to become inevitable. However, there is a certain lag on China’s copyright protection system, it let interior design works at any time by the high risk of infringement. In particular, due to the hysteresis of the legislation, resulting in the determination of the rights of the interior design works based on the emergence of a monism and dualism differences. The existence of such differences will not be conducive to the maintenance of the interests of the relevant subject,therefore, must be established in the legislation as soon as possible to protect the basis of the right to design works. On the basis of comprehensively analyzing the essence of interior design work from plane to stereo, it can be learned that dualism is superior to monism in protecting interior design work.
