摘　　要：生态环境问题终究是一个政治问题,其最终解决需要依靠制度和法治。20世纪60年代以来,世界范围内生态社会运动方兴未艾,享有良好的生态环境成为各国人民的价值追求。世界范围内绿色政治发展的大潮中,以宪法为代表的法律体系也逐渐开始了生态化进程。建构一种生态良好的社会,必须追溯到社会政治权力结构中去,以"权利"限制和规范"权力"。其中,环境权被确立为一项基本人权并写入多国宪法,成为宪法生态化趋向的基点。在政治实践中,环境权入宪满足了人民对美好生活的需要,契合了生态文明时代特征。在更为深远的政治哲学意义上,环境权入宪有力地彰显了生态正义,促进了一个环境优美、生态良好社会的到来。The ecological environment issue,by all means,is a political one,and its ultimate solution depends on institution and the rule of law.Since the 1960 s,ecological and social movements have been on the rise across the globe,and the experience of a good ecological environment has become the value pursuit of the people of all countries.In the tide of green political development around the world,the legal system represented by the constitution has gradually begun the process of ecological development.This article proposes that the construction of an ecologically sound society must be traced back to the social and political power structure,and"power"should be restricted and regulated by"rights".Among them,the right to the environment has been established as a basic human right and written into the constitutions of many countries,taken as the basis of the ecological trend of constitution.In political practice,the entry into constitution of environmental rights meets the people’s needs for a better life and conforms to the characteristics of the era of ecological civilization.In a more far-reaching political and philosophical sense,the entry into constitution of environmental rights powerfully demonstrates ecological justice and accelerates the arrival of a society with beautiful environment and health ecology.
