摘 要:《青少年法治教育大纲》的颁布对青少年法治教育的实施提出了新的目标,对于提升青少年的法治思维与法治能力具有重要意义,但根据不同学龄所确立的方案存在阶段目标不明确、教学内容要求过高、实施途径同一、保障措施范围不全面等新问题。究其根本原因,在于未看到大学生群体法治教育的特殊性而缺乏专门的、相对独立的顶层设计。基于国民教育的层次性、学生权利义务的差异性及高校教育考核的包容性等客观原因,应当突出强调大学生法治教育的特殊性,具体而言包括教育对象、教育内容及教育方法等的特殊性。文章提出,应当在特殊性理念的指导下,教育部门、高校、教师队伍等多个主体共同努力,推动大学生法治教育由知识传授到法治信仰培育、从教师说教到师生对话、从守法教育到公民教育的转型,从而实现大学生法治教育的专门化发展,使其成为法治建设的重要阵地。The promulgation of the outline of the rule of law education for young people puts forward new goals for the implementation of the rule of law education for young people, which is of great significance for improving the thinking and ability of the rule of law of young people. However, according to the plans established by different school age, there are some new problems,such as unclear stage goals, too high requirements for teaching content, the same way of implementation, and incomplete scope of safeguard measures. The reason lies in the lack of special and relatively independent top-level design due to the lack of the particularity of College Students’ legal education, which is the inevitable result of integrating the legal education in primary and secondary schools into the same system. Based on the level of national education, the differences of adult students’ rights and obligations, and the inclusiveness of higher education assessment, we should highlight the particularity of College Students’ legal education, including the particularity of education object, education content and education method. Therefore, under the guidance of the concept of particularity, education departments, universities, teachers and other subjects should work together to promote the transformation of College Students’ rule of law education from knowledge imparting to the cultivation of belief in the rule of law,from teacher preaching to teacher-student dialogue, from law-abiding education to civic education, so as to realize the specialized development of College Students’ rule of law education and make it an important position for the construction of the rule of law.
