论区块链技术在民事司法应用中的价值、风险和进路

摘　　要：区块链技术采用分布式数据存储、点对点传输、共识机制和加密算法等计算机技术并具有去中心化、公开透明、不易篡改和可追溯等特征,其信任价值所带来的公平、正义、效率、透明等系列价值与民事司法所遵循的基本原则和所追求的目标高度契合。采用区块链技术存证固证、采用全自动化智能合约开展民事执行和实行电子民事送达将是区块链技术应用于民事司法的理想场景。为了防止区块链技术应用碎片化所带来的效果减损和使区块链技术的应用有效解决民事司法现有的疑点、难点和痛点,在将区块链技术应用于民事司法时既需要保持区块链技术本身的完整性,也需要做好顶层设计、先行先试和整体推进。同时,还需要制定相关的法律、法规、司法解释和内部规定,并对现存的相关法律、法规、司法解释和内部规定予以修改或废止。Blockchain technology adopts computer technologies such as distributed data storage,point-to-point transmission,consensus mechanism and encryption algorithm.It has the characteristics of decentralization,openness and transparency,resistance to tampering and traceability.The value such as fairness,justice and efficiency,transparency brought about by its trust value are highly consistent with the basic principles and goals pursued by civil justice.The ideal scenarios for the application of blockchain technology to civil justice will be the use of blockchain technology to store certificates,the use of fully automated smart contracts to carry out civil execution and the implementation of electronic civil service.In order to prevent the effect of the fragmentation of the application of blockchain technology from degrading and to enable the application of blockchain technology to effectively solve the existing doubts,difficulties and pain points of civil justice,it is necessary to maintain the integrity of the blockchain technology and top-level design,first trial and overall advancement are required when applying blockchain technology to civil justice.At the same time,relevant laws,regulations,judicial interpretations and internal regulations need to be formulated,and relevant existing laws,regulations,and judicial interpretation and internal regulations shall be modified or rep ealed.
