摘　　要：[目的/意义]针对我国数据跨境管理体系国际博弈中的被动地位,归纳分析欧盟与美国的治理模式,完善我国数据跨境管理模式。[方法/过程]收集整理中、欧、美的数据跨境管理相关文献与资料,系统梳理了三方治理模式的价值选择、战略规划、立法确权、机构设置和合作机制,构建战略价值导向-战略工具-管理主体能力三维比较分析框架,总结欧盟和美国的特点和优势。[结果/结论]针对我国存在的不足,利用三维框架分析美国与欧盟的管理差异与共通经验,据此为完善我国数据跨境管理提出推动数据全生命周期法律规制保障和合作机制、基于公共数据权益打造中国模式、推进国家大数据产业和技术的跃迁的建议。[Purpose/Significance]In view of the passive position of our country's cross-border data management system in the international game,the paper summarizes and analyzes the governance models of the EU and the United States,and improves our country's cross-border data management model.[Method/Process]Collecting and sorting out documents and materials related to data cross-border management in China,Europe,and the United States,systematically sorting out the value selection,strategic planning,legislative confirmation,institutional setting and cooperation mechanism of the tripartite governance model,the paper builds a three-dimensional comparative analysis framework of strategic value orientation-strategy tool-management subject capacity,and summarizes the characteristics and advantages of the EU and the United States.[Result/Conclusion]In view of the shortcomings of our country,the three-dimensional framework is used to analyze the management differences and common experience between the United States and the European Union,and based on this,to improve the cross-border management of data in my country,we propose some suggestions,such as promoting a legal regulation guarantee and cooperation mechanism for the entire life cycle of data,building a Chinese model based on public data rights and interests,and advancing the transition of the national big data industry and technology.
