摘 要:中俄北极能源合作开发是“冰上丝绸之路”的重要组成部分。中俄北极能源合作开发将极大改善我国能源短缺现状,提升我国在北极公域治理中的话语权。受到北极区域环保标准严苛、俄罗斯域内法律制度变动频繁等法律风险影响,我国参与中俄北极能源合作的阻力重重。完善的国际法律制度是我国规避法律风险的有力保障,而现有国际法律制度专属性、约束力不足等问题凸显,这既不利于“冰上丝绸之路”建设,也不利于保障国家能源安全。为保障中俄在北极能源合作中的能源开发利益最大化,中俄两国应当借助联合国、北极理事会等权威性平台助推专属性国际条约、具有实质约束效力的区域性多边协定以及中俄能源投资双边协定的完善与构建。The cooperation and development of Arctic energy between China and Russia is an important part of the"Ice Silk Road".Cooperation of China and Russia in Arctic energy development will greatly improve China's energy shortage situation and enhance China's voice in Arctic public domain governance.Due to the severe environmental protection standards in the Arctic region,frequent changes in the legal system in Russia and other legal risks,China's participation in the Arctic energy cooperation between China and Russia has many obstacles.A perfect international legal system is a powerful guarantee for China to avoid legal risks.However,the existing international legal system has some problems,such as the lack of specificity and binding force,which is not conducive to the construction of the"ice silk road"and the protection of national energy security.In order to maximize the benefits of energy development between China and Russia in the Arctic energy cooperation,China and Russia should build exclusive international treaties,regional multilateral agreements with both hard and soft laws and bilateral energy investment agreements with the help of authoritative platforms such as the United Nations and the Arctic Council.
