电影作品著作权侵权损害赔偿的现实困境与路径选择

摘　　要：电影作品作为著作权保护的特殊客体,其侵权损害赔偿存在对赔偿方法的判断不准确、赔偿数额的确定不明晰、赔偿责任的分配不清楚等现实问题。基于此,应采取适当引入资产审计的前置程序,通过期待利益、比较法等方式科学计算著作权人的实际损失;运用综合考虑法、许可使用费法、成本收益均值法等多种方法确定法定赔偿额;合理分配纠纷双方的举证责任,从而完善电影作品著作权侵权的损害赔偿,保障著作权人的合法权益,促进影视行业的健康有序发展。As a special object of copyright protection,the compensation for tort damages of film works has some real problems,such as inaccurate judgment of compensation method,unclear determination of compensation amount,unclear distribution of compensation liability and so on.Based on this,the pre-procedure of asset audit can be introduced appropriately,and the actual loss of copyright owner can be calculated scientifically by means of expecting benefits and comparative law;secondly,use various methods,such as comprehensive consideration,licensing fee,mean cost and income,to determine the statutory damages;thirdly,distribute the burden of proof reasonably between the disputing parties to improve the damage compensation for copyright infringement of film works,protect the legitimate rights and interests of copyright owners,and promote the healthy and orderly development of the film and television industry.
