智慧时代马锡五审判方式精髓的弘扬

摘　　要：马锡五审判方式所蕴含的群众路线的基本精神和司法为民、公正司法的精髓,与当前司法领域应用大数据、云计算、人工智能、5G网络等现代科技手段促变形成的司法为民利民便民、推动司法公开公正、提升司法质量效率的要义息息相通。在智慧时代,继承和弘扬马锡五审判方式的核心要义是在智慧法院建设中,进一步挖掘其精髓,凸显其价值,弘扬其精神,并借助现代科技落实到具体司法实践中。建议以提升司法为民、公正司法为目标,开发完善功能齐备、更接地气的智能化软件,促进庭审实质化改革,建立线上诉讼调解和多元化纠纷解决机制平台,提高法官队伍运用“法律+科技”的能力和水平,运用智慧手段助推普法宣传与诉讼服务,为人民群众提供优质高效的司法服务。The basic spirit of the Mass line and the essence of justice for the people and Fair Administration of Justice embodied in the Ma Xiwu Trial Mode is closely connected with the main meaning of using cloud computing,big data,artificial intelligence,5g network and other modern science and technology in judicial field to promote the justice for the people,to promote judicial openness and justice,and to improve judicial quality and efficiency.In the era of wisdom,the core of inheriting and carrying forward Ma Xiwu Trial Mode is to excavate its essence,highlight its value and carry forward its spirit in the construction of the smart court,and to carry it into the concrete judicial practice by means of modern science and technology.We suggest that with the goal of promoting the administration of Justice for the people and fairness,we should develop and improve the intelligent software with complete functions and more grounded atmosphere,promote the substantive reform of court hearings,and establish a platform for online litigation mediation and diversified dispute resolution mechanisms.We improve the ability and level of the judges in applying law+Science and technology,and promote legal publicity and litigation services by means of wisdom to provide high-quality and efficient judicial services.
