摘　　要：人民监督员制度不可否认有其缺陷,但人民监督员制度的理念却是政治文明、法治建设发展的方向,人民监督员制度开启了人民监督制度化的伟大实践。国家监察体制改革只是改变了权力架构,并没有改变检察机关的宪法性质,作为监督者,自侦权即使“花落别处”,人民监督员制度也仍有“用武之地”,人民监督员制度更是一个全新的课题。在后自侦权时期,对人民监督员制度之人民监督员产生、监督范围、监督程序、监督效力等进行深刻反思,以期切实发挥人民监督员制度之功用。It is undeniable that the people’s supervisor system has its defects,resulting in low“efficiency”,but the concept of the people’s supervisor system is the developmental orientation of political civilization and construction of judicial system,and the people’s supervisor system has initiated the great practice of the institutionalization of people’s supervision.The reform of the national supervisory system only changes the power structure,but does not change the constitutional nature of the procuratorial organ.As a supervisor,even if the procuratorial investigation power is removed,the people’s supervisor system still“plays its role”,and the people’s supervisor system is a brand new subject.In the post-procuratorial-investigation-powerperiod,profound reflection on the generation,scope,procedure and effectiveness of the people’s supervisor system should be made in order to give full play to its functions.
