权利扩张与家庭理性博弈下的中国家庭建设

摘　　要：当代中国家庭之中,家庭成员个人利益在家庭之中不断扩张,出现了"权利泛化"现象,这从中国当前日益走高的离婚率和出轨率中可见一斑。虽然当前立法、司法实践通过部分制度设计实现了家庭伦理的有效回归,一定程度上矫正了个人利益的扩张,但是基于中国传统伦理的现代化转型程度难以把握的现实,当前法律制度中个人利益与家庭伦理关系出现了部分畸形。要实现中国家庭的正义格局,需要以社会主义核心价值观为主导,将社会主义核心价值观融入到立法目的、价值与解释之中,以矫正个人利益与家庭伦理的畸形关系;同时,需要司法实践中以家事审判改革为契机,完善多元化纠纷解决机制,让伦理回归家庭审判之中,成为释法说理的有效依据;需要通过社会主义核心价值观指导下的立法与司法联动,在个人利益与家庭伦理的平衡之中实现中国家庭的正义格局。In contemporary Chinese families, the personal interests of family members are constantly expanding in the family, and the phenomenon of"generalization of rights"has appeared, which can be seen from China’s currently rising divorce and derailment rates.Although the current legislative and judicial practice has realized the effective return of family ethics through part of the system and suppressed the expansion of personal interests to some extent.But because of modernization transformation of traditional Chinese ethics, there is a deformity in personal interests and families.To realize the justice structure of the Chinese family, it is necessary to take the core values of socialism as the lead and integrate the core values of socialism into the legislative purpose, values and interpretations, in order to correct the abnormal relationship between personal interests and family ethics.The family trial reform is an opportunity to improve the multiple dispute resolution mechanism and return ethics to family trials.Through the linkage of legislation and judicial guidance under the guidance of socialist core values, the justice structure of Chinese families will be realized in the balance of personal interests and family ethics.
