优化营商环境视阈下我国政府采购制度的完善构想

摘　　要：政府采购制度对营商环境具有重大影响。从优化营商环境的视阈察之,我国政府采购制度主要存在缺乏协调统一的制度体系、缺少完善的监管制度和欠缺多元高效的争议解决制度等问题。鉴此,我国首先应当以《政府采购法》修改和加入GPA为契机,采取"两步走"的完善策略,构建协调统一的政府采购制度体系。其次,应当确认政府采购协议的行政协议属性,将之纳入完整的政府采购监管之中,赋予对政府采购协议的行政诉权。最后,应当设置中立的争议审查机构,建立公正灵活、高效多元的争议解决制度。如果对《政府采购法》进行以上修改并与其他相关制度创新形成合力,必将助力我国法治化营商环境建设跨上新台阶。The government procurement system has a major impact on the business environment.From the perspective of the optimization of the business environment,major deficiencies in the government procurement system in China are the lack of coordinated and unified system,perfect supervision system,and multiple and efficient dispute settlement mechanism.In this regard,China is supposed to seize the opportunities of revising The Government Procurement Law of the People ’s Republic of China and joining the government procurement agreement(GPA),and construct a coordinated and unified government procurement system through a "two-step" strategy.Furthermore,the attribute of the administrative agreement should be confirmed for the government procurement agreement so that it can be brought into the complete supervision of the government procurement,and the government procurement agreement can be given the right of administrative litigation.Finally,it is suggested to set up a neutral dispute review body,and establish a fair,flexible,efficient,and pluralistic dispute resolution mechanism.The Government Procurement Law of the People’s Republic of China is supposed to be revised according to the above-mentioned suggestions,and can further form synergy with other relevant institutional innovations.Thus,the construction of a law-based business environment in China will be further enhanced and promoted to a new level.
