云平台环境中专利执法的联动机制研究

摘　　要：近年来,随着互联网技术的发展,云平台环境中侵害专利权的行为日益猖獗,极大地损害了专利权人的合法权益。在双轨制专利权保护模式下,专利行政执法扮演着重要角色,但因对云平台层级缺乏差异性分析、云平台环境中侵权行为纠察难和认定难,以及行政处罚权不足、行政调解缺乏强制执行力等问题,传统扣押侵权产品、封存涉及侵权的服务器等措施难以完全遏制云平台环境中的侵权行为。鉴于云平台的技术特征,执法部门应充分调动云平台运行过程中不同角色的积极性,强化专利执法部门的异地执法能力,增强联动机制中的专利执法与行政调解效果,发挥云平台环境中专利执法的积极动能,缓解侵权频发的态势。In recent years,with the development of Internet technology,infringement of patent rights in the cloud platform environment has become increasingly rampant,greatly damaging the legitimate rights and interests of patentees.Under the dual-track patent protection model,administrative enforcement of patents plays an important role.However,due to the lack of analysis of differences in cloud platform levels,the difficulty of picking up and identifying infringements in the cloud platform environment,the lack of administrative penalties,and the lack of enforcement of administrative mediation traditional measures such as the seizure of infringing products and storage of infringing servers cannot completely curb infringements in the cloud platform environment.In view of the technical characteristics of the cloud platform,law enforcement agencies should fully mobilize the enthusiasm of different roles in the operation of the cloud platform,strengthen the remote law enforcement capabilities of the patent law enforcement agencies,enhance the effect of patent law enforcement and administrative mediation in the linkage mechanism to give full play to patents in the cloud platform environment,and alleviate the situation of frequent infringement.
