黑恶势力利用信息网络实施违法犯罪研究

摘　　要：近年来,贵州省黑恶势力利用网络信息技术实施违法犯罪情况呈现出高发态势,表现为利用视频直播平台、网络平台、微信平台、手机APP等信息网络系统实施违法犯罪牟取非法利益。具体形式有:通过炫耀暴力、传播非法影响力而受雇为他人摆平事端、暴力讨债,通过"套路贷"等实施诈骗、敲诈勒索、寻衅滋事等违法犯罪行为,实施网上召嫖组织卖淫、聚众赌博、开设赌场等。分析贵州省黑恶势力利用网络信息技术实施违法犯罪行为的成因,提出黑恶势力利用信息网络实施违法犯罪的打击对策:要用好用足法律武器,予以严厉打击;要多警协作,线上线下合成作战;要扩线侦查,挖掘罪行,为认定犯罪组织的黑恶性质提供支撑;要抓住时机,多措并举,全面规范收集证据材料。In recent years,the illegal acts and crimes committed by Mafia-like gangs via information networks are happening with increasing frequency in Guizhou Province,and are manifested by committing unlawful or criminal activities to obtain illegal benefits by means of live video platforms,network platforms,WeChat,mobile APPs and other information network systems.The specific forms include:showing off violence and spreading illegal influence to get hired to settle matters and violently collect debts for others;committing fraud,extortion,or picking quarrels and provoking troubles through "Taolu loans" or other means;organizing and participating in prostitution,gathering together to gamble or opening casinos via the Internet and etc.This paper analyzes the causes for the crimes committed by Guizhou Mafia-like gangs via information networks and puts forward following countermeasures:making the most of sufficient legal weapons to crack down on such crimes;strengthening different police departments’ cooperation in online and offline operations;expanding the scope of investigation,digging out the criminal clues supportive for the identification of the Mafia-like nature of the criminal organizations;seizing the opportunities,taking multiple countermeasures to collect all-sided evidence materials.
