摘　　要：对非营利法人的法律规定和属性进行分析,可以更加清晰地理解国家鼓励和引导社会力量举办非营利性医疗机构这项政策。通过结合《民法典》来阐述"非营利性"的含义,并对实践中非营利性医疗机构的一些营利性行为进行梳理,进而从立法完善、政策促进和机构管理三个方面,提出有关非营利性社会办医发展的建议,在"健康中国"战略的推行中发挥更积极的作用。Analyzing the legal requirements and attributes of non-profit legal persons can provide a clearer understanding of the policy of encouraging and guiding social capital to set up non-profit medical institutions.According to‘Civil Code’this article explains the meaning of‘non-profit’,and sorts out some profit-making behaviors of non-profit medical institutions in practice.Then,from the aspects of legislative improvement,policy promotion and institutional management,it puts forward suggestions on the development of non-profit nongovernmental medical services,and plays a more active role in the implementation of the Healthy China strategy.
