摘  要:中国共产党第十九大报告中提出了党政机构合设合署的要求。此次机构改革,使部分党的机构享有了行政权能,并直接参与到国家治理的进程中。这一变革对我国诸多行政法理论与制度提出了诸多挑战。为确保对这些问题回应的内核一致性,需深入至"政治与行政""政党与法律"的核心关系层面对改革作高屋建瓴式的思考。应基于"择一适用"原则,对党政机构改革对当前行政主体理论、行政救济制度、行政领导制度产生的影响进行客观、冷静的思考。The report of the Nineteenth National Congress of the Communist Party of China put forward the requirement for the joint establishment of party and government agencies.This institutional reform has enabled some party institutions to enjoy administrative power and directly participate in the process of state governance.This change has posed many challenges to many administrative law theories and systems in our country.In order to ensure the core consistency of responses to these issues,it is necessary to go deep into the core relationship of"politics and administration"and"party and law"to think highly of reforms.Based on the principle of"select one and apply",we should objectively and calmly think about the impact of the reform of the party and government institutions on the current administrative subject theory,administrative relief system,and administrative leadership system.
