摘 要:随着社会主义市场经济体制的逐步建立和发展,建设工程造价鉴定应运而生。市场经济条件下,工程造价的确定是通过市场竞争在合同中约定的。由于合同当事人对利益追求的目标不同,个别当事人未按合同约定履行相关义务,因而产生了合同纠纷。当事人之间不能通过和解的方式解决纠纷时,诉讼或仲裁就成为解决合同纠纷的最终渠道,而纠纷解决的焦点就集中在工程造价的确定上。由于建设工程的专业性和复杂性,人民法院或仲裁机构往往需要借助工程造价专业人员和相关机构,对待证事实的专门性问题进行鉴别和判断,并出具工程造价鉴定意见来辅助委托人对待证事实进行认定,因此,工程造价鉴定工作就成为审理建设工程合同纠纷案件的重要内容。文章重点从工程造价鉴定事项及鉴定范围权属的确定、鉴定人进行释明的必要性以及对相关法律法规条款的释义等方面给予相关人员一些实操建议,为推进工程造价纠纷的快速解决、改进工作提供助益。The appraisal of construction project cost came into being with the gradual establishment and development of the socialist market economy system.Under market economy conditions,the project cost is determined through market competition and agreed in the contract.Because the parties to the contract pursue different goals for their interests,the contract awareness is not strong,and some parties do not perform as agreed in the contract,resulting in contract disputes.After contract disputes arise,the parties may not be able to reach an amicable settlement,and litigation or arbitration becomes the last channel for resolving project contract disputes.People’s Courts or arbitration institutions often need to use project cost appraisal to identify and judge the specific issues of the facts to be evidenced,and also issue expert opinions to assist the principal in identifying the facts of the evidence.Therefore,the appraisal of the project cost has become an important part of the trial in disputes over construction contracts.This article will give relevant personnel practical suggestions on the appraisal items and appraisal scope from the practice of project cost appraisal and the interpretation of relevant laws and regulations.It also includes determination of the ownership of the appraisal items and the scope of the appraisal,the necessity of the appraiser’s explanation,the time and method of the appraiser’s explanation and the appraiser’s exemption due to his due diligence.The purpose is to provide assistance in promoting the rapid resolution of project cost disputes and work improvement.
