中美贸易战影响下的我国知识产权国际协调机制研究

摘　　要：2018年爆发的“中美贸易战”加剧了世界利益格局的失衡,其实质是发展中国家与发达国家在知识产权国际规则话语权上的博弈。如果说从《巴黎公约》到TRIPs协议的第一次知识产权国际协调机制转换依然立足于全球治理视角,那么发达国家签署的ACTA为代表的第二次机制转换就意味着知识产权国际协调机制被“撕裂”“中美贸易战”则使该机制面临被进一步“撕裂”的风险。致力于国际规则维护的大国担当,我国与美国《第一阶段经贸协议》的签署在一定程度上阻止了该形势进一步恶化,形成了知识产权国际规则新的平衡点。作为“当事国”以及最大的发展中国家,我国一方面要落实相关承诺,加快完善国内有关知识产权法律制度,实现法治化;同时也要通过“一带一路”倡议建立信息共享机制、增强各国之间的技术交流与合作,积累知识产权国际规则话语权,以抵御发达国家对国际规则的破坏。The trade war between China and the United States that broke out in 2018 aggravated the imbalance of the world interest pattern,and its essence was the game of the discourse power of the international rules of intellectual property rights between developing countries and developed countries.From the Paris Convention to the TRIPs agreement of intellectual property rights,for the first time the international coordinating mechanism transformation is still based on the global governance perspectives,so the second mechanism transformation represented by ACTA signed by developed countries means that the international coordination mechanism of intellectual property rights has been"torn",and trade war makes the mechanism face the stronger risk of“being torn”.China is committed to upholding international rules as a major country.The signing of the First Stage Economic and Trade Agreement between China and the United States has,to a certain extent,prevented the situation from deteriorating further and formed a new balance point for international rules.As the“country concerned”and the largest developing country,on the one hand,China should fulfill its relevant commitment,accelerate the improvement of the domestic intellectual property law system to realize the rule of law.On the other hand,“The Belt and Road”initiative should also be adopted to establish an information sharing mechanism,enhance technical exchanges and cooperation among countries,and accumulate the right to speak in the interna-tional rules of intellectual property,so as to prevent the developed countries from breaking the international rules.
