摘　　要：从法律法规视角分析数据隐私治理问题有助于明确我国数据隐私治理的法律保障,并为完善数据隐私治理法律法规提供参考。文章采用规范分析法,在厘清数据、数据隐私、数据隐私权3个核心概念以及数据隐私关联的数据类型、侵犯数据隐私权的主要形式2个相关问题的基础上,依据数据隐私治理的全国性法律法规,从权利、义务、责任3方面解析数据隐私治理的法律规范,探讨加强我国数据隐私治理的法律对策。我国虽然颁布了21部全国性数据隐私治理法律法规,但还存在许多缺陷。为了给数据隐私治理提供充分的法律保障,应制定《隐私法》,建立健全我国数据隐私治理的法律体系;以完善《个人信息保护法(草案)》为契机,筑固数据隐私治理机制。It is helpful to clarify the legal guarantee of current data privacy governance in China and provide reference for further improvement in domestic data privacy governance laws and regulations by exploring data privacy governance from the perspective of domestic laws and regulations.After clarifying the three core concepts of data,data privacy and right to data privacy,as well as two issues related to the data types associated with data privacy and the main forms of infringement of data privacy,this paper analyzed legal norms of domestic data privacy governance from the aspects of rights,obligations and responsibilities according to national laws and regulations governing data privacy,by the use of normative analysis methodology,and discussed the legal countermeasures to strengthen data privacy governance in China.Although China has enacted 21 nationwide laws and regulations on data privacy governance,there are still some defects.In order to provide sufficient legal protection for data privacy governance in China,we should formulate the Privacy Law and establish and improve the legal system of data privacy governance in China,formulate the Data Protection Law and create the data privacy governance mechanism,take the improvement of Personal Information Protection Law(Draft)as an opportunity to strengthen the data privacy governance mechanism in China.
