摘 要:不动产交易中如何评价在先占有人的权利,进而理顺占有与登记的关系,目前缺乏确定的结论。最高人民法院刊登的公报案例--连成贤诉臧树林案,从实践的角度肯定了占有不动产的意义,然而不少学者仍持有不同意见。由这一典型案例出发,理顺个案中在先占有人与登记人的关系,探究相应的应用规则与论证逻辑,进而从法律、历史、社会等角度证实引入占有制度的正当性与普适性,寻找现行规则基础上纳入占有制度的路径,借鉴国外先进经验,引入查知义务,将占有纳入到“善意”的认定中,在现行《民法典》下进行制度设计,以期完善不动产物权制度。In the real estate transaction,there is a lack of proper conclusion on how to evaluate the rights of the prior possessor,and then straighten out the relationship between possession and registration.The case of Lian Chengxian′s lawsuit against Zang Shulin published by the Supreme People′s court affirmed the significance of possession of real estate from the practical point of view,but many scholars still hold different opinions.Starting from this typical case,this paper straightened out the relationship between the first possessor and the registrant in the case,explored the corresponding application rules and the logic of argument,and then confirmed the legitimacy and universality of the introduction of possession system from the perspective of law,history and society,found the path to incorporate the possession system on the basis of the existing rules,drew on the advanced experience of foreign countries,introduced the duty of investigation,brought possession into the recognition of"good faith",the system is designed under the current civil code in order to perfeet the real right system of real estate.
