摘　　要：环境信息法学作为一门新兴交叉学科,有其自身的产生背景和发展意义。在人类社会已经发展到生态文明与信息文明并存融合发展的新时代,有必要对环境信息法学的学科建设与学科发展问题进行全面、系统与深入的探讨。就环境信息法学的学科建设与学科发展而言,目前该学科正处于学科“自我构建”阶段,其学科内涵、学科定位、理论体系等基本问题仍需系统探讨和深入研究,如此才能牢牢把握环境信息法学的发展方向,进而为环境信息治理变革提供科学的理论指导和智力支持。在学科内涵问题认知层面,环境信息法学的研究对象是环境信息法的现象及其规律,核心范畴是“环境信息权利—环境信息权力统一体”,主要目标是打造环境信息共建、共治、共享的治理格局。在学科定位问题认知层面,环境信息法学是环境法学与信息法学相互衔接与交叉的学科。在理论体系问题认知层面,环境信息法学的体系架构应当包括环境信息法哲学、环境信息法史学、中国环境信息法学、国际环境信息法学等四个部分。As a new interdisciplinary subject,environmental information law has its own background and development significance.As human society has developed into a new era in which ecological civilization and information civilization coexist and co-develop,it is necessary to conduct a comprehensive,systematic and in-depth discussion on the subject construction and development of environmental information law.As far as the discipline construction and discipline development of environmental information law are concerned,the discipline is currently in the“self-construction”stage,and basic issues such as its connotation,discipline positioning,and theoretical system still need to be systematically explored and studied in depth,so that we firmly grasp the development direction of environmental information law,and then provide scientific theoretical guidance and intellectual support for the reform of environmental information governance.At the cognitive level of disciplinary connotation,the environmental information law studies into its phenomenon and its rules,with the core category of“Environmental Information Rights—Environmental Information Power Unity”,aiming to create the governance structure of environmental information co-construction,co-governance and share.In the cognition of disciplinary positioning,environmental information law is a discipline that connects and intersects environmental law and information law.At the cognitive level of theoretical system issues,the system framework of environmental information law should include four parts:philosophy of environmental information law,history of environmental information law,information law of Chinese environmental,and information law of international environment.
