摘 要:我国行政执法已经广泛运用了行政约谈,但也存在一些不足,影响其功能得到更好的发挥。依据行政约谈介入行政相对人的时间与法律效力的强弱,行政约谈可以分为警示型、制止违法预备型、消除轻微违法型、警示履行处罚决定型、制止拒绝履行处罚决定预备型和消除轻微拒绝履行处罚决定型。在此基础上对我国行政约谈的立法进行分析,提出相应的完善建议,实现行政约谈立法的法治化。In China,administrative talk is applied extensively in the administrative enforcement,however,there is a key issue about the insufficient rule of law in administrative talk.This problem makes it difficult to maximize its functions of administrative talk.The administrative talk is divided for several types according to the legal effect strength and time sequence,accordingly,there are six types of the administrative talk,namely the warning type,the preventing preparatory violations type,the eliminating minor violations type,the warning type for carrying out obligations set by administrative penalty,the type for preventing obligations repudiation of administrative penalty and eliminating minor obligations repudiation of administrative penalty.Based on analysis,we propose corresponding solutions to put administrative talk into the rule of law track.
