摘 要:在我国东南沿海及经济发达地区,存在着许多商品房化的农村小区。作为城市化的重要载体,城市专属的停车难问题也同样困扰着这些小区,这也导致农村小区车位权属纠纷愈演愈烈,村民、租户以及相关管理部门都陷入其中,我国的专家学者以及作为生活百科全书的《民法典》却没有关注和回应这一社会热点问题。本文通过梳理义乌四层半小区车位权属纠纷的相关问题,理清背后的法律逻辑,希望通过集体车位使用权这一全新的用益物权的设立来解决农村小区车位权属纠纷。in China's southeast coastal and economically developed areas,there are many commercial housing rural areas.As an important carrier of urbanization,the problem of urban exclusive parking also perplexes these communities,which also leads to the increasingly fierce disputes over the ownership of parking space in rural communities,in which villagers,tenants and relevant management departments are involved.However,China's experts and scholars as well as the"Civil Code"as an encyclopedia of life have not paid attention to and responded to this social hot issue.This paper combs the related issues of parking space ownership disputes in Yiwu four and a half floor community,clarifies the legal logic behind,and hopes to solve the disputes of parking space ownership in rural communities through the establishment of collective parking space use right,a new usufructuary right.
