论重大公共安全事件中公民人身自由权的限缩与保障——以全球性新冠疫情防控社会治理视角分析

摘　　要：自2020年初以来,新型冠状病毒开始在世界大范围传播,中国采取诸多效果显著的疫情管控措施。与此同时,少部分地区行政机关及其措施执行者为追求疫情防控秩序而无视公民人身自由权的现象时有发生,对政府形象及其社会稳定造成较为恶劣的影响,不利于国家法治秩序、社会和谐稳定。从国家宪法及其相关部门法对人身自由权的保障入手,描述人身自由权的涵义在肯定疫情防控期间限缩人身自由权具有合法性和必要性的同时,限缩与保障公民人身自由权的前提和界限是使其必须遵循法律保留原则、比例原则,保障公民核心权利。公民人身自由权与疫情防控秩序之间的关系实质上就是在探讨保障公民人身自由权与正当行使公权力之间的关系,如何使两者处于一种平衡状态,对于国家与个人保障公民权利和正当行使公权力都尤为重要。Since the beginning of 2020,the novel coronavirus has begun to spread worldwide, and China has adopted many effective control measures. At the same time, in order to pursue the order of epidemic prevention and control,a small number of regional administrative organs and their measures implementers often ignore the citizens’ right to personal freedom, which has caused adverse impacts on the government image, and is not conducive to the national rule of law and social harmony and stability. Starting with the protection of the right of personal freedom in the national constitution and its relevant department laws, this paper describes the meaning of the right of personal freedom, affirms the legitimacy and necessity of restricting the right to personal freedom during the period of epidemic prevention and control, and expounds the premise and limits of restricting the right of personal freedom,which meansthe principles of legal retention, proportion, and protecting the core rights of citizens must be followed.. This study also finds that the essence of the relationship between the right of personal freedom and the order of epidemic prevention and control is to explore the relationship between the protection ofcitizens’ right to personal liberty and the legitimate exercise of public power, and how to make the two in a balanced state is particularly important.
