摘 要:面对竞价排名侵权纠纷,法院基于搜索引擎服务商不存在明知或应知侵权行为的情形、已尽到注意义务、无实质审查信息的义务等理由,一般都判决搜索引擎服务商除接到对方通知之后删除涉嫌违法的链接之外,无须承担其他责任。然而,竞价排名是广告行为,具有营利性质,不应适用避风港原则。与此同时,搜索引擎具有公共性,服务商应承担相应的义务。因此,搜索引擎服务商在竞价排名时应负有实质审查义务和区分性显示义务。When it comes to the infringement by the paid listing of search engines,based on reasons that the provider of search engine has done all the duty of care,no situations of knowing or should-know the infringement and without the obligation of substantial examination information burdened on the provider of search engine etc.,courts made decision that the provider of search engine don't need to take responsibility except deleting suspected illegal links after the notice.Paid listing is a kind of advertising behavior through the search engine which is a profit-making service,so its infringement should not be applicable to the principle of safe harbor.Search engine is a public instrument,which means they should bear corresponding obligation.Therefore,the provider of search engine in the provision of paid listing service should have substantial the obligation to review the content and the obligation to display the outcome different from the normal one.
