基于新修订《档案法》的档案利用权与公布权权责问题研究

摘　　要：2020年6月20日,新修订的《中华人民共和国档案法》颁布,对档案利用与档案公布条款进行了修正。文章基于新修订《档案法》涉及的档案利用与档案公布条款,回顾了我国档案利用权与公布权讨论热点,分析了现存法规在公布与利用的权责、公布审核程序以及国外立法趋势中存在的问题,最后提出要转变档案开放思想,完善开放鉴定程序,取消公布权的审核,以及进一步完善档案法与相关法律法规的关系的建议。Based on the provisions of the newly revised Archives Law on the use and publication of archives,this paper reviews the brief history and discussion hot spots of the development of the right to use and publish archives in China,analyzes the existing laws and regulations in the right and responsibility of publication and utilization,the procedures for publication and audit,and the trend of foreign legislation,and finally puts forward some suggestions to change the open mind of archives,improve the open identification procedure,cancel the audit of the right to publish,and further improve the relationship between the archives law and relevant laws and regulations.
