摘　　要：植物新品种保护制度是种子法中的重要构成部分,对保护育种者权益和促进育种创新具有重要的意义。中国农业植物新品种保护制度自建立以来,在促进农业发展方面的成效显著。但随着国内外形势的变化,也呈现出一些不相适应之处。通过对《中华人民共和国植物新品种保护条例》实施以来中国农业植物新品种保护进展与成效的总结,对中国植物新品种研发情况进行简要介绍,分析了目前中国农业植物新品种保护面临的形势与问题,并提出了健全中国农业植物新品种保护制度的建议和对策。The protection system of new varieties of plants is an important part of seed law,which is of great significance to protect the rights and interests of breeders and promote breeding innovation.Since the establishment of new varieties protection system of agricultural plants in China,it has achieved remarkable results in promoting agricultural development.But with the situation change at home and abroad,there are also some incompatibilities.By summarizing the progress and effectiveness of the new agricultural plant varieties protection in China since the implementation of the Regulations on the Protection of New Plant Varieties of the People’s Republic of China,the research and development of new plant varieties in China was introduced,and the current situation and problems existing in the new agricultural plant varieties protection were analyzed,some suggestions and countermeasures to improve the new varieties protection system of agricultural plants in China were put forward.
