摘　　要：医托问题由来已久,且遍布在各个大型医疗机构及其周边,虽经长期的专项治理,但始终无法从根本上解决。厘清“医托”概念及其特征,明晰医托所侵犯的法益,探究医托严打不尽的原因,并结合现行法律,明确依法治理医托的法律适用,是有效治理医托的关键。Medical scalpers have long existed,and can be found all over various large medical institutions and the surrounding areas.Although after long-term special management,the problem can not be fundamentally solved.And the following are the keys to manage them effectively:clarifying the concept and characteristics of medical scaplers,clarifying the legal benefits that medical scaplers infringe,exploring the reasons why the problem of medical scaplers cannot be resolved,and clarifying the legal application that manage medical scaplers by combining the current laws.
