摘　　要：传统新闻媒体依靠内容而得以存在,新闻聚合平台则是以技术取胜的代表。5G时代信息传播的特点决定了新闻聚合平台将在竞争中具有更大的优势,传统新闻媒体则面临更多的挑战和被侵权的风险。我国以"著作权法+反不正当竞争法"保护新闻出版者利益的弱保护模式已经不符合5G时代的要求。设立新闻出版者邻接权符合邻接权产生的历史逻辑和市场规律,在保护水平上更符合5G时代的特点。《著作权法》第三次修改将报社、期刊社等的工作人员创作的职务作品纳入特殊职务作品的范围,体现了加强保护新闻出版者利益的倾向。但总体来看,此修改仍偏于保守。我国未来在新闻聚合平台的治理上可以考虑适时在《著作权法》中增设新闻出版者邻接权条款。Traditional news media rely on their news content to make a living,while news aggregation platforms have achieved success by their technology.The characteristics of information dissemination in the 5G era determine that news aggregation platforms will have a greater advantage in competition,while traditional news media face more challenges and the risk of being infringed.The weak protection mode of protecting the interests of press publishers by"Copyright Law and Anti-unfair Competition Law"in China does not meet the requirements of the 5G era.Establishing of the neighboring rights of press publishers conforms to the historical logic and market laws of the rising of neighboring rights,and is more in line with the characteristics of the 5G era in the level of protection.The third revision of the"Copyright Law"included works created by staff of newspapers and periodicals into the scope of special works created in the course of employment,reflecting the tendency to strengthen the protection of the interests of news publishers.But overall,this modification is still conservative.Copyright Law can add the neighboring rights clause of the press publishers in the future governance of news aggregation platform.
