摘　　要：在遭遇风险时的抵抗能力和决策能力,可以在一定程度上体现一个国家的治理能力。随着时代更迭,信息公开已逐渐成为国家治理的重要手段。国家在进行风险治理时,存在信息公开主体权限不明确、信息公开程序缺位等困境。政府应将突发重大公共卫生事件等具有代表性的风险事件的处理作为切入点,抓住风险治理现代化背景下信息公开观念转变是关键,分析信息公开各阶段中存在的利益冲突,力求找到公共利益与私人利益之间、公众知情权与个人信息权之间、公共卫生防治与个人信息保护之间的平衡点,据此通过完善各主体间的多元互动机制、合理运用免责规则以及明确删除权的合法化等方法来建立完善的信息公开制度。The resistance and decision-making ability of a country in the face of risks can reflect the national governance ability to a certain extent.In the context of the current risk society,the system design of information disclosure has become the key to national governance.In the risk rule of law,there are some difficulties,such as the unclear authority of the subject of information disclosure,the absence of information disclosure procedures and so on.Taking the treatment of representative risk events such as sudden major public health event,this paper explores the critical significance of transformation of the concept of risk governance modernization,analyzes the interest conflicts in various stages of information disclosure,and strives to find the balance between public interests and private interests,public right to know and right to personal information,public health prevention and control and personal information protection.Based on this,we can establish perfect information disclosure system by improving the multiple interaction mechanism among the main bodies,reasonable use of exemption rules and legalization of deletion rights.
