大学生参与高校治理的法治路径研究

摘　　要：高校学生参与权的切实保障是大学善治的内在要求。而学生参与大学治理中存在的诸多法治缺陷是学生参与不足的重要原因。学生参与机制法治水平的提升,是提高高校内部治理水平的优先选择。学生参与高校治理的法治路径包括:应充分完善学生参与的相关立法和高校章程,充分保障学生的参与主体地位;厘定学生参与的范围和边界,确保学生参与的广度和深度;健全学生参与的程序制度、完善学生参与权的救济途径,为学生参与权的实现提供程序和救济保障。The effective guarantee of student participation right is the inherent requirement of good governance in universities.However,many legal defects in the process of students′participation in university governance are important reasons for students′insufficient participation.Therefore,perfecting the legal system of student participation mechanism is the first choice to improve the internal governance level in universities.The rule of law path for students to participate in the governance includes the following points:the relevant legislation and university constitution of student participation should be fully improved to protect students′dominant role in the governance process;the scope and boundary of student participation should be determined to ensure the breadth and depth of student participation;the procedural system of student participation and the relief approaches of student participation right should be perfected to provide the procedure and relief guarantee for the realization of student participation right.
