摘 要:产权作为一项财产权,在市场经济背景下,却成了私有历史建筑被破坏或沦为利益纠纷的工具。在现实中,"游戏规则"的冲突与产权权利细分下私人利益与社会公共利益的矛盾,以及复杂的产权关系是当前掣肘私有历史建筑保护的主要原因。如何平衡私益与公益是私有历史建筑保护不可回避的重要问题。在分析东莞市茶山镇南社古村对私有历史建筑保护与私人产权协调的实践经验基础上,总结南社古村在平衡私益与公益的新探索,以期为其他地区提供经验与反思。As a property right,in the context of market economy,property right has become a tool for private historical buildings to be destroyed or become a dispute over interests.In reality,the conflict of“game rules”,the contradiction between private interests and social public interests under the subdivision of property rights,and the complex relationship of property rights are the main reasons restricting the protection of private historical buildings.How to balance private benefit and public benefit has become an inevitable and important issue in the protection of private historic buildings.This paper will analyze the practical experience of the coordination between private historical building protection and private property right in Nanshe Ancient Village,Chashan Town,Dongguan,and summarize its new exploration in balancing private interests and public welfare,so as to provide experience and reflection for other regions.
