摘 要:电子商务领域中的市场竞争越发激烈,随之滋生出假冒伪劣、虚假宣传等各种不正当竞争行为。相对传统商务中不正当竞争行为,电子商务中的不正当竞争行为形式更为多样,如何在电子商务中对不正当竞争进行有效的法律规制成为法学领域研究的一个焦点。本文从电子商务中不正当竞争的内涵入手,总结电子商务中不正当竞争的常见形式及成因,分析现有不正当竞争法律规制的不足,并探寻相应的解决对策,试图为电子商务中不正当竞争的法律规制提供一些有益的借鉴。The market competition in the field of e-commerce is becoming more and more fierce,which breeds a variety of unfair competition behaviors such as fake and shoddy products and false publicity.Compared with the unfair competition behavior in traditional business,the forms of unfair competition behavior in e-commerce are more diverse.How to effectively regulate unfair competition in e-commerce has become a focus of research in the field of law.Starting from the connotation of unfair competition in e-commerce,this paper summarizes common forms and causes of unfair competition in e-commerce,analyzes deficiencies of existing legal regulation of unfair competition,and explores corresponding solutions,in an attempt to provide some useful reference for the legal regulation of unfair competition in e-commerce.
