网络第三方支付中侵财犯罪的定性研究

摘　　要：利用网络第三方支付侵犯他人财产的行为包括私转他人第三方支付平台账户余额和通过第三方支付平台私转他人信用卡内资金两种情形。认定利用网络第三方支付侵犯他人财产的行为应从法律关系入手。在私转他人第三方支付平台账户余额的行为中,第三方支付机构是财物的占有者,行为人擅自使用他人账户和密码转账使支付机构陷入认识错误并处分财物,构成诈骗罪。通过第三方支付平台私转他人信用卡内资金包括两种情况:一是私转他人第三方支付账户已绑定的信用卡内资金,二是私自将他人信用卡与第三方支付账户绑定进而转移卡内资金。对于后者,司法实务和刑法学界已一致认为其构成信用卡诈骗罪;对于前者,该行为实际上导致银行被骗后处分卡内资金,也构成信用卡诈骗罪。The behavior of infringing others′property by using the third-party payment on the Internet constitutes two situations:privately transferring the balance of the third-party payment platform account and transferring stealthily the funds in the credit card through the third-party payment platform.The Identification of behavior of property infringement by means of online third-party payment should be based on the perspective of legal relations.While unauthorizedly transferring the account balance of the third-party payment platform,since the third-party payment institution is the possessor of property,the actor′s unauthorized use of other′s account and password for transference makes the payment institution fall into the wrong understanding and dispose of property consequently,which constitutes the crime of fraud.There exist two ways to transfer the funds in other person′s credit card via the third-party payment platform:one is to transfer unauthorizedly the funds in other person′s credit card that has been bound by the third-party payment account,the other is to transfer the funds in the card by stealthily binding other person′s credit card with the third-party payment account.For the latter,judicial practice and criminal law scholars agree that it constitutes the crime of credit card fraud;for the former,it actually leads to the disposal of the funds in the card after the bank is cheated,which also constitutes the crime of credit card fraud.
