海南自由贸易港数据跨境流动法律规制研究

摘　　要：数据跨境流动规制是海南自由贸易港建设的重要一环。安全、有序、便利、开放是海南自由贸易港数据跨境流动所持的价值取向。海南自由贸易港数据跨境流动法律规制,面临着事权厘定不清、法律体系不完善以及监管体制不健全等事权、法治、制度三大方面难题。建议坚持“事权法治制度环境一体化”的方略和路径,在借鉴国际经验的基础上,在海南自由贸易港数据跨境流动领域构建厘清事权分配、完善法律体系、健全监管体制三位一体法治化路径,以便对海南自由贸易港数据跨境流动进行有效法律规制。The regulation of cross-border data flow is an important part of the construction and development of the Hainan free trade port.Security,order,convenience,and openness are the value orientations of the legal regulation of the cross-border flow of data in the Hainan Free Trade Port.In the development of the regulation system for cross-border data flow in the Hainan free trade port,it is bound to face three major problems:unspecified power,imperfect legal system and defective supervision system.It is suggested to adhere to the strategy and path of“integration of administrative,legal and institutional environment”,and build a three in one legalization path in the field of cross-border data flow in the Hainan free trade port on the basis of international experience,including clarifying the distribution of administrative power,improving the legal system,and improving the regulatory system and mechanism,so as to effectively carry out the legal regulation of cross-border data flow in the Hainan free trade port.
