档案利用权利保障的难点与对策——基于国家档案馆义务履行的视角

摘　　要：满足档案利用需求、保障档案利用权利,是人民主权这一宪法性原则在档案领域的具体体现。从义务履行的视角来看,国家档案馆在档案利用权利保障中担负着档案利用服务的告知义务、给付义务和保障义务。结合档案工作实践来看,国家档案馆在义务履行过程中面临着档案开放鉴定工作较为缓慢、档案利用服务能力相对不足、档案利用服务机制亟待优化等问题。建议从优化档案资源结构、提升档案服务水平、健全档案责任体系、加强档案监督检查四个方面,增强国家档案馆的义务履行能力。To meet the needs of archives utilization and protect the right of archives utilization is the concrete embodiment of the constitutional principle of people’s sovereignty in the field of archives.From the perspective of obligation performance,the National Archives undertakes the obligation of informing,payment and guarantee in the protection of archives utilization rights.Combined with the practice of archives work,the national archives is faced with some problems in the process of performing its obligations,such as the slow opening of archives,the lack of archives service ability,and the urgent need to optimize the archives service mechanism.It also needs to optimize the structure of archives resources,improve the service level of archives,improve the responsibility system of archives,and strengthen the supervision of archives to enhance the ability of national archives to fulfill their obligations.
