摘　　要：人体生物样本库知识产权权利归属与利益分享制度作为一项具有约束和激励功能的制度安排,可以在一定程度上协调生物样本库与研究者、人体生物样本提供者等利益相关方的不同利益需求。在人体生物样本库的实际运作过程中,有必要通过加强利益相关方渐进的沟通与协调,引导各方形成理性预期,探寻出具有合理性、适配性以及内在层次性的具体路径,进而建构起以知识产权和利益分享为轴心的人体生物样本库样本和数据的获取与利用机制,促进生命科技领域创新能力的增强和公共健康福利的提升。In the context of human biobank,as a constraint and incentive institutional arrangement,the ownership of intellectual property rights and the benefit sharing system,to some extent,can coordinate the different interests and needs of all relevant stakeholders which including human biobanks,genetic sample donors,researchers and so on.To promote public health welfare and the innovation ability in the life science and technology field,in the operation of human biobank,it is necessary to strengthen communication and coordination among all relevant stakeholders gradually,and explore the rational,adaptable and hierarchical pathways,then to builed the policy on access to and uses of human genetic samples and data with intellectual property and benefit sharing system as the axis.
